COURT PROPOSALS RUSHED AND WRONG SAYS PROBATE JUDGE

WOODSTOCK - When an organization has 26 staff people doing the work usually assigned to 29 people, what would you expect that organization to do?
The answer, in the case of the Vermont Supreme Court, is to reduce the size of the staff to 21 without changing the total workload.

W0ODSTOCK - As the old year turned, legislators across Vermont heard from the Assistant Judges among their constituents, as the judges argued the case not only for preserving the office, but expanding it.
The judges' letter begins, "We are urging you to support legislation that will expand the duties and responsibilities of Vermont's 28 Assistant Judges. This is one sure way to guarantee that all Vermonters will continue to have access to high-quality judicial services at the lowest possible cost."

Woodstock, VT - A 2002 U.S. Supreme Court decision offers support to Assistant Judge William Boardman's argument
that what he said and wrote during the 2006 election was protected speech under the First Amendment of the U.S. Constitution.
Judge Boardman is appealing a recent order of recommendation from the Vermont Judicial Conduct Board,
which seeks to punish him for things he said and didn't say near the end of the 2006 election campaign.
In 2002, the U.S. Supreme Court, in Republican Party of Minnesota v. White, held that a Minnesota rule
dealing with political speech during a judicial election campaign violated the First Amendment.
Writing for the court's 5-4 majority, Associate Justice Antonin Scalia observed that,"the First Amendment does
not permit [the State] to achieve its goal by leaving the principle of elections in place while preventing the
candidates from discussing what the elections are about."

JUDGE BOARDMAN FILES NOTICE OF APPEAL TO SUPREME COURT

WOODSTOCK – Assistant Judge William Boardman, acting through his attorney, has filed his notice of appeal with the Vermont Supreme Court, challenging the recent “order of recommendation” issued by the judicial conduct board on May 13. Judge Boardman has filed within the 30-day appeal period, which effectively postpones any action on the board’s order for the time being.
Judge Boardman’s appeal is based in large part on the clearly erroneous “facts” propounded by the board, many of them contradicted by the documentary evidence before the board, or the testimony, or both. As a result of relying on clearly erroneous assertions of fact, Judge Boardman argues, the board has failed to meet its burden of proof – the board has not supported its complaint with clear and convincing evidence.
“Clear and convincing” is a high burden of proof, though not as stringent as “Beyond a reasonable doubt.”

The annotations to Judge Boardman's media advisory below are to show
(A)what changes Vermont Standard editor Kevin Forrect had to make in the advisory to create the false impression that it was a letter to the editor;
(B)that the advisory was and is true in all meaningful aspects; and that
(C)to understand the advisory, one must understand its context -- personal attacks on Judge Boardman that have continued from December 2005 to the present..
The advisory appears in different forms and contexts in Exhibits 11, 11A, and 12, with 11A showing the re-written
advisory in its larger published context. The advisory as written and distributed by Judge Boardman appears
in Exhibit 12, together with a contemporaneous note trying to correct board counsel's early mischaracterization.

To the Editor,
After several news outlets inaccurately reported that I had been suspended as an Assistant Judge, I asked for a correction and a few news outlets granted my request. The Vermont Standard, a Woodstock weekly, did not print a correction of its erroneous story, but did run this letter in a somewhat different form.
For the record, I have NOT been suspended. The judicial conduct board’s “order of recommendation” will have no force until and unless the Supreme Court ratifies it, and I have yet to see a news report that got this right the first time around.

To the Editor of the Vermont Standard,
Thanks to the Standard for running my letter to the editor on May 22. I wrote it as a press release, which the editor converted into a letter to the editor, with my prior review and approval, although none of this was disclosed.
The Standard's refusal to run a correction of its original story, however, is not so admirable. The Standard's story (May 15) begins: "The Vermont Judicial Conduct Board has suspended [the judge].." This is inaccurate. I have not been suspended. The board's opinion will have no force until and unless the Supreme Court ratifies it. The Standard is not alone in getting this wrong. I have yet to see a media report that got it right.

Judge Appeals Suspension
Montpelier, Vermont - May 21, 2008
A Windsor County side judge found guilty of misconduct is appealing his suspension.
[Somewhat misleading -- I've not been suspended yet and can't be without action of the Supreme Court after 30 days. What I'm appealing is the recommendation that I be suspended.]
The Judicial Conduct Board recommended William Boardman be suspended for six months. State regulators say he had a conflict of interest in a local non-profit organization, and disseminated false information during his last campaign.
[There is NO allegation that I distributed false information, because I did not. There is an allegation that I didn't apologize for information that was not designated for publication, but was mistakenly published without my consent. This is also a First Amendment issue of constitutionally protected free speech.] ...

POSSIBLE SUSPENSION OF JUDGE COULD PUNISH COUNTY COURTS

WOODSTOCK - Despite a flurry of news stories suggesting otherwise, Assistant Judge William Boardman of Windsor County has not been suspended from any of his duties, judicial or executive. That won't happen till mid-June, at the soonest.
In the event that an Assistant Judge is suspended from all his duties, the impact on Windsor County would include disruption of the small claims docket, added stress on the Judicial Bureau's traffic and municipal ordinances docket, disruption of the Family Court's uncontested divorce docket, and the inability of county government to function.
In a widely reported press release last week, the Judicial Conduct Board (JCB) gave the false impression that Assistant Judge William Boardman ...
